TERMS OF SERVICE

1. LEGAL IDENTIFICATION

In compliance with Article 10 of Law 34/2002 (LSSI-CE), Play with Piano is operated by LEOM MUSIC LAB, S.L., with NIF B26672378 and registered office at Calle General Serrano No. 21, Piso 2, 38004 Santa Cruz de Tenerife, Spain. 2. SERVICE DESCRIPTION

LEOM MUSIC LAB, S.L. provides a subscription-based streaming service for high-fidelity classical piano accompaniments. The service is intended for users who are at least 18 years of age or have obtained parental or guardian consent to subscribe. The service is for personal, non-professional use and is provided on an “as is” and “as available” basis.

3. SUBSCRIPTIONS, BILLING, AND CANCELLATION

• Recurring Billing: Subscriptions are handled and billed through the Apple App Store or Google Play Store.

• Right of Withdrawal: Pursuant to Article 103.m) of the Spanish General Law for the Defense of Consumers and Users, by accessing the content, you expressly agree to the immediate performance of the digital service and acknowledge that you forfeit your right of withdrawal (refund) once streaming begins.

• Cancellation: You may cancel your subscription at any time via your App Store settings.

• Price Changes: Fees may be modified at any time. Changes will be communicated with reasonable notice through the app or your provided contact information.

4. INTELLECTUAL PROPERTY AND USAGE LICENSE

• Ownership: LEOM MUSIC LAB, S.L. retains all rights to the audio recordings, mastering, editing, and software.

• License: Users are granted a limited, non-exclusive, and non-transferable license for personal streaming use only.

• AI & Data Mining: The use of content for data mining, scraping, or as input for training Artificial Intelligence (AI) or machine learning models is strictly prohibited.

• Recording over tracks: Recording yourself over the tracks for public distribution or commercial purposes is strictly forbidden unless a separate commercial license is obtained.

5. ACCEPTABLE USE

Users agree not to copy, distribute, resell, or commercially exploit the content. Any attempt to decompile the software or to circumvent digital rights management (DRM) will result in immediate termination. 

6. DISCLAIMER OF WARRANTIES AND LIABILITY

LEOM MUSIC LAB, S.L. does not warrant that the service will be uninterrupted or free of errors. Liability is limited to the fullest extent permitted by law and shall not exceed the amount paid for the active subscription period.

7. GOVERNING LAW AND JURISDICTION

These terms are governed by Spanish law. For disputes arising with other businesses or professionals, the parties submit to the jurisdiction of the Courts of Santa Cruz de Tenerife, Spain. However, in cases where the user acts as a consumer, the competent jurisdiction shall be the courts of the consumer's domicile, in accordance with applicable consumer protection laws. 

8. MODIFICATION TO TERMS

LEOM MUSIC LAB, S.L. reserves the right to amend these terms at any time. Continued use of the service following such changes constitutes your acceptance of the updated terms.

9. SPECIAL FEATURE "REQUEST A PIECE" (WISHLIST AND FAST-TRACK)

9.1 Standard Request (Community Wishlist).

• Eligibility: This feature is available to all registered users (Free and Premium).

• Workflow:

• • Submission: Users may submit one (1) "Standard Request" per month.

  • Approval: LEOM MUSIC LAB, S.L. will moderate the request based on copyright availability, technical complexity, and appropriateness.

  • Community Voting: Approved requests will be listed on the "Community Wishlist," where all users can vote for their favorite piece.

  • Production: At the end of each month, the two (2) most-voted pieces will be produced and added to the General Premium Library.

• Company Rights: LEOM MUSIC LAB, S.L. reserves the right to modify the production schedule or substitute a winner if technical or legal impediments arise.

9.2 "Fast-Track" Service.

• The "Fast-Track" service is available to all registered users who wish to prioritize a specific recording.

• By purchasing a "Fast-Track" (Consumable Product), LEOM MUSIC LAB, S.L. guarantees that the approved piece will be produced and available in the App within seven (7) business days.

• Availability: This service is strictly limited to four (4) slots per month globally.

9.3 Intellectual Property and Distribution.

• Notwithstanding the payment of the Fast-Track fee or the request through the Wishlist, LEOM MUSIC LAB, S.L. retains full and exclusive ownership of all intellectual property rights, including master recordings and interpretative versions.

• Once produced, the piece will be incorporated into the General Premium Library. Access to stream or use this content is strictly reserved for Premium Subscribers. Users on the Free tier will not have access to the resulting content unless they upgrade to a Premium Subscription.

9.4 Service Availability and Refunds.

• If LEOM MUSIC LAB, S.L. fails to deliver a Fast-Track recording within the 7-day period, the user will be entitled to a full refund of the fee, processed through the respective platform (Apple App Store or Google Play Store).
